What is DUI?

DUI (Driving Under the Influence) is the commonly used abbreviation for the criminal act of operating a moving vehicle after consuming alcohol or drugs. The term DUI encompasses a range of offenses, which vary depending on the laws in your state and county. Some people use the terms driving under the influence, driving while intoxicated, impaired driving, drunk driving, or drinking and driving. BAC (blood alcohol content) can be determined using a Breathalyzer test, urine test, or blood test. Breathalyzers rely on indirect methods of measurement of blood alcohol concentration. Some people in law enforcement may consider a high BAC measurement to be the strongest evidence for police and prosecutors. This is not always the case and many times there are reasonable doubts about their maintenance, use, and results. Breathalyzers are the most commonly used form of chemical sobriety tests, and are also possibly the most inaccurate. Any traces of gas, liquids (blood), or vomit can affect the results of the test. Field sobriety tests – such as walking in a straight line– may also be used to determine if a person is sober and able to operate their vehicle. A DUI may result in jail time, loss of license, or prison sentence, fines, higher insurance rates and may entail mandatory participation in a drug/alcohol rehabilitation program or community service.
